Welcome to Insta360's AI templates function (herein referred to as "AI Themes" or "This Function"). Please read this instruction carefully before use, especially the terms regarding exclusions or limitations of liability.

I. Functions and Services of AI Themes

To provide deeper editing services and improve creative output, we offer various editing templates based on generative AI technology. Specific content, function descriptions, and operation guides are based on the product function page. Please read the operation guide and relevant usage regulations carefully when using (if any), as these regulations form part of this instruction.

II. User Usage Regulations

During the use of the Insta360 AI Themes function, please be aware of and comply with the following regulations:

Comply with laws and regulations, fulfill information security obligations, and respect morals. Do not use the AI Themes for illegal activities or to spread illegal or illicit content.
When generating, creating, publishing, or distributing AI content, we have the right to add marks according to laws and regulations. You must follow the mark management requirements and not obscure, modify, or delete these marks.
Respect privacy ethics, protect data security, and do not input or share unauthorized personal information, confidential information, etc.
Respect others' legal rights, do not input or share unauthorized content, and do not infringe on others' intellectual property, portrait rights, etc.
Be civil, and abide by the user behaivor as outlined in the "Insta360 User Service Agreement".

You agree that the content you input is legal and compliant, and is either owned by you or authorized. If you engage in illegal activities, we will retain records and have the right to report to relevant authorities, requesting you to provide supporting materials. If third-party rights are harmed due to improper use of this function, you are responsible for the consequences, and if we incur losses, we reserve the right to pursue legal responsibility.

III. Intellectual Property

When you use AI Themes, you may submit text, images, videos, and other input content to us (collectively referred to as "Input Content"). We respond by generating images, videos, and other output/generated content (collectively referred to as "Output Content") based on your input content. The specific types of input and output content are subject to the actual product functionality. You understand and agree that the input content must be owned by you or you have obtained legitimate authorization (including sublicensing) from the rights holder, and does not violate applicable laws and regulations, infringe on others' legal rights (including but not limited to copyrights, patents, trademarks, and other intellectual property rights, as well as personal rights, personal information rights, etc.), or contain content violating public order or morals. Within the scope permitted by applicable law, the intellectual property rights and other property interests (if any) of the output content generated using Insta360 AI Themes belong to you. However, if the input content and/or output content contain our intellectual property or other legitimate rights, the respective rights or interests related to the input and/or output content still belong to us and are not changed by being included in the output content.
To improve services, you grant us and/or our affiliates the right to use your input content and/or output content for the purpose of providing services, optimizing products, and ensuring service safety and stability. This right is free, sublicensable, transferable, global, non-exclusive, permanent, and can be re-licensed.

IV. User Personal Information Protection

To enable functionality, we need to transfer the original materials you voluntarily select or upload to the server of a third-party algorithm service provider for processing. Some AI Theme functions may analyze materials containing faces or voices, but rest assured that your original materials will only be used for generating specific effects and will not be used for identifying or verifying personal identities, nor will they be used for model training. If you have any claims, requests, or questions regarding your personal information rights, you can email dpocontact@insta360.com. We will respond within fifteen working days after verifying your identity.

V. Limitations of Function and Liability Statement

Due to the nature of technology and AI, it is difficult to guarantee that the output content is true, accurate, or reliable. The output content is for reference only and does not constitute reliance information or advice. For matters of significant impact, it is recommended to consult professionals. You are responsible for judging the output content and assuming the associated risks and legal responsibilities.
We make efforts to filter inappropriate/harmful content but may make mistakes. Please provide timely feedback if issues arise, and we will continue to optimize the model.
You should use the technology legally, comply with relevant laws and regulations, and assume legal responsibility for any unlawful behavior. You are responsible for the consequences and liabilities arising from your actions based on the output content.
AI Themes are provided "as is." Although we strive to ensure service continuity and security, due to technical limitations, we cannot guarantee perfection, nor can we foresee or prevent all risks. We are not liable for various damages, and unless otherwise stipulated by law, our liability is limited to the fees paid for the usage period (if any).
The output content does not represent our attitude, views, or position. If there are any unpleasant, inappropriate, or offensive contents, please provide feedback via email to service@insta360.com.

VI. Others

This instruction is part of the "Insta360 User Service Agreement"" and the "Insta360 App Privacy Policy," and has the same legal effect. In case of conflicts, this instruction prevails. For matters not mentioned, the other two agreements shall apply.
To provide better services or due to changes in laws, technology, or products, we may revise this instruction. After updating, we will notify you through appropriate means, and you can review the latest version on the relevant page.
